This Privacy Policy explains how KyperX Pty Limited (“KyperX”, “we”, “us” or “our”) collects, holds, uses and discloses personal information. We are committed to handling personal information consistently with the Privacy Act 1988 (Cth) and the Australian Privacy Principles where they apply.

1. Scope

This policy applies to personal information handled by KyperX Pty Limited through kyperx.com and in the course of its business activities. KyperX AI and KyperX Capital are operated by KyperX Pty Limited and may publish supplemental privacy notices for particular activities or collections. Any supplemental notice should be read together with this policy and applies to the specific collection it describes.

2. Personal information we collect

The kinds of personal information we may collect and hold include:

• identity and contact details, such as your name, email address, telephone number and postal address, where provided;
• professional details, such as your organisation, role and business contact information;
• the enquiry category you select, the contents of your message, and any details you choose to provide about your role, organisation website, project, stage, timeframe and requirements;
• when you submit an enquiry, how you reached the website: the page where your visit began, the address of the referring website, any campaign tags in the link you followed, the page that led you to the form, and the time of submission;
• records of our correspondence and dealings with you; and
• technical information generated when you use the website, such as your IP address, browser and device type, requested pages, referring page, and the date and time of a request.

Please do not provide sensitive information through the website unless we have specifically requested it and you consent to us collecting it for a purpose reasonably necessary for our functions or activities, or the collection is otherwise permitted by law. If we receive unsolicited sensitive information, we will assess whether we could lawfully have collected it and, if not, take reasonable steps to destroy or de-identify it.

3. How we collect and hold information

We generally collect personal information directly from you when you submit the contact form, email or telephone us, meet with us, or otherwise communicate with us. We may also receive information from a person who refers you to us, from your organisation, or from publicly available professional sources where this is reasonably necessary for our activities.

Our website hosting provider automatically creates limited technical logs for security, diagnostics and service reliability. Information may be held in our form-processing, email and business record systems.

You may deal with us anonymously or by using a pseudonym where lawful and practicable. However, if you do not provide sufficient contact or other relevant information, we may be unable to respond to or act on your enquiry.

4. Why we collect, hold and use information

We may handle personal information to:

• respond to enquiries and communicate with you;
• assess and manage potential projects, partnerships, research collaborations, supplier relationships, employment matters and corporate enquiries;
• manage our business relationships and maintain appropriate records;
• operate, secure, maintain and improve the website and our systems;
• detect, investigate and prevent misuse, security incidents or unlawful activity;
• comply with legal and regulatory obligations and protect our lawful interests; and
• carry out another purpose with your consent or where permitted or required by law.

We do not sell, rent or trade personal information. We do not currently arrange for computer programs to use personal information to make, or do anything substantially and directly related to making, decisions that could reasonably be expected to significantly affect an individual’s rights or interests.

5. Disclosure of personal information

We may disclose personal information, where reasonably necessary, to:

• KyperX personnel and contractors who need it to perform their duties;
• service providers supporting our website, form processing, email, cloud storage, information technology and security;
• professional advisers, insurers, auditors and other advisers engaged by us;
• a party involved in an actual or proposed corporate transaction, subject to appropriate confidentiality arrangements; and
• regulators, courts, law-enforcement bodies or other persons where permitted or required by law.

We do not disclose personal information to third parties for their own direct-marketing purposes.

6. Overseas processing and disclosure

Some service providers used to operate this website and deliver enquiries are based in, or use infrastructure located in, the United States. As a result, personal information may be processed or stored outside Australia, particularly in the United States.

Where we disclose personal information to an overseas recipient, we take reasonable steps appropriate to the circumstances to ensure that the information is handled consistently with applicable Australian privacy requirements. Overseas recipients may also be subject to the laws of their own country.

7. Cookies, analytics and external links

At the date of this policy, kyperx.com does not use advertising cookies, advertising networks or behavioural analytics. Our hosting and security providers may nevertheless process technical request data and use technologies that are strictly necessary to deliver, protect and maintain their services.

We use cookieless website analytics, provided by our hosting provider, to understand in aggregate how the website is used. It records the page visited, the referring page, and the approximate location (country), browser, operating system and device type of a visit. It does not use cookies, is not used to identify you, and does not track you across other websites.

To understand which pages and campaigns lead to enquiries, the website keeps a note in your browser’s session storage of the page where your visit began, the address of the website that referred you, and any campaign tags in the link you followed. A new note starts if you arrive through another campaign link or from another website. Where the note includes campaign tags or a referring website, the same details are also added to the address of links to our enquiry form, so they are kept if the form opens in a new tab. The note stays in that browser tab, is deleted when the tab is closed, and is sent to us only if you submit the enquiry form, together with your enquiry and the page that led you to the form. Our analytics also records, in aggregate, visits to our engagement pages, which enquiry links are used, which engagement path is chosen, and whether an enquiry was started, sent or failed to send, without the content of the form or any personal information.

The website may link to third-party websites. Those websites are governed by their own privacy practices, and KyperX is not responsible for how they handle personal information.

8. Direct marketing

We do not currently operate a general marketing mailing list through kyperx.com. If we send you a direct-marketing communication in the future, we will do so in accordance with applicable law and will provide a simple way to opt out. You may also ask us at any time not to send you direct marketing.

9. Security and retention

We use reasonable administrative, technical and organisational safeguards designed to protect personal information from misuse, interference, loss and unauthorised access, modification or disclosure. The website is delivered over HTTPS, and access to personal information is limited to authorised persons with a business need. No method of internet transmission or electronic storage is completely secure.

We retain personal information only for as long as reasonably necessary for the purposes described in this policy, to resolve disputes, or to satisfy legal, accounting and reporting obligations. When information is no longer required, we take reasonable steps to destroy it or de-identify it.

10. Access, correction and deletion requests

You may ask to access personal information we hold about you or request that it be corrected. You may also ask us to delete information, although we may need to retain some information where permitted or required by law. To make a request, contact our Privacy Officer using the details below and provide enough information for us to identify the relevant records.

We may need to verify your identity before acting on a request. We will respond within a reasonable period and, if we refuse access or correction, will provide written reasons where required by law.

11. Privacy complaints

If you believe we have mishandled your personal information, contact our Privacy Officer and describe your concern. We will acknowledge and investigate the complaint and aim to provide a substantive response within 30 days. If we need more time, we will explain why and provide an expected response date.

If you are not satisfied with our response, you may contact the Office of the Australian Information Commissioner (OAIC) through its website or by telephone on 1300 363 992.

12. Changes to this policy

We may update this policy when our information-handling practices or legal obligations change. The current version, including its effective date, will be published at kyperx.com/privacy.
